Law and Provenance

Title page of a Sotheby and Co. sale of Egyptian, Greek, Roman and Cypriot antiquities, London, 11 and 12 November 1926 (Metropolitan Museum of Art Libraries, via the Internet Archive)

The laws that now decide whether a Cypriot antiquity may be sold, imported or claimed back almost all date from after 1970, while most of the Cypriot objects abroad left the island long before. The entries in this part of the section set out the international conventions, the import rules of the United States, the European Union and the United Kingdom, how Cyprus and its Church have recovered objects by buying them as well as by going to court, what the returns of recent years were, and what counts as proof that an object left the island lawfully.

How to use these entries

The entries are in two groups. International law covers the 1954 Hague Convention and the 1970 UNESCO Convention, the United States memorandum with Cyprus and its list of restricted material, and the import rules of the European Union and the United Kingdom. Recovery and proof covers the policy of buying objects back, the returns of 2023 to 2026 read together as a body of cases, and how an owner, heir or buyer documents a lawful history.

Each law turns on a date: the date an object left Cyprus, not the date it was made. Cyprus's own law is set out in sequence, from the Ottoman firmans to the end of licensed export in 1996, in the legal export of Cypriot antiquities, and what it means for a collector now in collecting Cypriot antiquities today. Why the year 1974 has become the line against which an undocumented object is judged is covered in the 1974 presumption, and the kinds of paper a lawful history leaves in lawful and illicit in the record.
