Re: Estate of George H. McFadden, II, Deceased

Dear Dr. Rainey:

Thank you for your letter of June 23rd with its enclosures.

1. Since George issued his personal check for $49.40 to the Libreria Commissionaria Sansoni which was not paid because it was not presented for payment until after his death, in my opinion the payee of the check has a valid claim against the Executors and I will, therefore, suggest to them that they issue their check in payment for the books. The ownership of the books may be determined later.

2. Unfortunately George's Will which was dated October 30th, 1950 revokes all prior testamentary writings. Therefore, the Executors cannot make any payments to the individuals named in the paper Christo received from George after Pearl Harbor and handed back to him in 1946 or under George's note of September 27th, 1943. Furthermore, the Executors cannot give any of those individuals any part of the bequest to charities to be selected by the Executors because these individuals are not charities. However, I will inform Mrs. Ewing and Mrs. Harrison of the facts so that they can decide whether they personally wish to give any sums to the individuals in question.
